General terms and conditions

By making your order you accept the following General Terms and Conditions of Andrea Kämmerer, Sionyx® Sportswear (subsequently referred to as Sionyx®).

1. Return

You can return all items that have been purchased at the Sionyx® Online Shop within 14 days upon receipt to the following address without naming the reasons:

Andrea Kämmerer, Sionyx® Sportswear, Edelweißstraße 8, D-82515 Wolfratshausen.

The deadline starts at the earliest upon receipt of the product. In order to meet the deadline you have to post the product in due time.

In the case of an effective return both parties have to return all received goods and services and restitute benefits as the case may be.
Please note that all returned products have to be in a condition corresponding to normal use for the purpose of examining the product. Sionyx® can demand damages in the case of impairment of the product caused by a use beyond examination.
In the case of return the buyer has to bear the mailing charges.

2. Delivery

Orders at the Sionyx® Online Shop are delivered exclusively within the European Union and Switzerland, usually by DPD (only Germany and Austria), Deutsche Post (German Mail) or DHL (Deutsche Post). Delivery time within Germany is normally 3 to 8 work days after the receipt of a complete and accurate order; custom-made products by arrangement. Delivery time within the European Union is normally 5 to 15 work days.

3. Mailing charges

Deliveries within Germany
The delivery is free of charges. Orders that are placed cash on delivery cause extra charges of 6,00 EUR.

Deliveries within the European Union
Deliveries within the European Union will be accepted only against cash in advance. The delivery is free of charges for an order value of more than 150,00 EUR; for an order you will be charged 4,00 EUR.

Deliveries within Switzerland
Deliveries within Switzerland will be accepted only against cash in advance. The delivery is free of charges for an order value of more than 150,00 EUR; for an order you will be charged 4,00 EUR.

Switzerland - customs and duties
Upon receipt of your order you will be the Swiss VAT. 7.6% offset by the net value of goods. There may be customs duties, for this we are not responsible!

4. Payment

All prices specified in the Sionyx® Online Shop include the compulsory VAT.

You can pay the merchandise at your own choice against cash in advance or cash on delivery.

Sionyx® is entitled to demand overdue fines as well as late interests in the statutory amount plus extra handling charges as the case may be, should you default in the payment.

5. Orders

The products shown at sionyx.de are no offer. The offer is effected by placing an order at the Sionyx Website and will be checked by us. Sionyx® reserves the right not to accept your order if an item is not available. Sionyx® will inform you as quickly as possible if an order cannot be effected.

6. Liability for defects

Sionyx® solely delivers products that have undergone an internal quality control. Any liability for defects is particularly excluded in the case of inappropriate use of our textiles. The contracting party has to claim a defect immediately, should there be apparent defects in the delivery. Otherwise the liability for apparent defects is excluded.

In the case of demonstrably defective performance or delivery we offer subsequent improvement or replacement at our choice. Subsequent improvements will be carried out at Sionyx®.

According to the legal regulations, the contracting party is entitled to withdraw from the contract, to lower the purchase price or to claim damages and reimbursement of expenses respectively if neither the subsequent improvement nor a replacement is being effected in due time by our negligence or if it has failed definitely. A subsequent improvement or replacement is considered to have failed after the second try if nothing else arises out of the situation, particularly out of the nature of the product or the defect or other circumstances.

At any rate, the liability is excluded if third persons who are not authorised by us tamper with the product.

The liability does not cover functional wearout and includes no free repair of the product.

In order to assert a liability claim, the buyer has to send the product free of charge to:

The mailing charges will be reimbursed by Sionyx® if the claim is recognised.

7. Conditional sale

The product remains property of Sionyx® until complete payment.

8. Obligation of secrecy

As a matter of principle all personal data are treated confidentially.

Your personal data will be processed, used and particularly saved for the purpose of processing and executing your order. Your concerns worthy of protection are being considered according to the legal regulations in the course of data processing.

Apart from the purposes mentioned above we use your data for marketing, particularly for marketing purposes concerning products of Sionyx®.

You can object or withdraw your consent to the processing, transmission and other use of your data for the purpose of marketing respectively anytime by giving notice to Sionyx® (ask_shop @ sionyx-shop.de). After receiving your objection or withdrawal, we won't use the concerned data for purposes of marketing and processing respectively and stop sending further advertising material immediately.
